Don't sign anything without an attorney looking at it. He will promise you anything that he thinks that you want to hear just to get your signature. After he gets you to sign, what's to guarantee that he'll live up to his promises??
Don't put yourself in a situation that could hurt both you and your children. Make sure you get an attorney!

Call a lawyer tomorrow. Many will give you your first consultation for free. I am assuming if you have been apart for a year that you will divorce because if not you would have probably worked things out by now.So if thats the case I think you will find that most states are 50/50 states., which means at divorce time you will get 50 percent of all liquid assets. So I don't see him giving you all the money for the house plus pay for all the turition. But if you follow a lawyers advise you are more than likely to get at least half of all the assets. Besides if you agree to finance then sell you will be further in debt if he is taking any cash out of the refinance thus your equity is less at selling time so how is that a good thing for you?...Call a lawyer

Do not go for this. Do not sign your name on the re-fi papers. Even if he makes a contract stating he'd do all that stuff, the law will only hold him to it for so long. Sell the house and split the profit. If you have that much equity in the home, you'll get it back by selling. If you don't want to move, you can buy his share of the house or vice versa.
Why the hell would you agree to anything this guy says when HE WALKED OUT ON YOU. You've got the upper hand. You have house and kids. If you don't have a job, you will get alimony. Get him for child support and keep EVERYTHING!

Get a lawyer and have him look over the documents. I wouldnt suggest ever signing anything the indicates you will not fight him in court, he could take the kids from you, make you pay him support, anything he wants. If you both want the divorce, sometimes you can get one attorney to draw up the papers and split the cost. Be sure you read everything before you sign it to protect yourself and your children.

GET A LAWYER!!!!!!!! before you sign anything. if he wants to write up a contract, tell him to have a lawyer write it up and give a copy to your lawyer. thats the smartest thing that you can do. BUT DEFINATLY GET A LAWYER!!!!

Both of you need attorneys, and they have to be actively involved in the process. An attorney will look out for your interests.
