No they are not ethical but how do you regulate something that has no physical or outward appearance? I understand while you might be referring to hidden messages on TV such as subliminal advertising, it goes far beyond this as folks in every walk of life practice this type of communication every day and openly, such as a lady discreetly throwing a fast flirt at a police officer to try and get out of a ticket, for instance. Now if the flirt is overt and really obvious and way out of line then that's one thing, but if it's a wink that might've just been her eyelid blinking involuntarily due to a speck of dust, how do you regulate this?
As far as I'm concerned, it's highly unethical to practice this type of behaviour if it's done on purpose and in order to twist or bend things to go one's way, but my best recommendation is that when someone pulls a stunt like that on you is to start walking away and don't deal with this person. And, you have to be sure because other than leading by example and not doing it yourself, and letting them know this behaviour is inappropriate, I'm afraid there's not much else can be done.
