to add to the question...the father and i are getting married this summer...and again we were split up when i had her n i gave her my last name...what would i have to do to change it to his last name,....

He needs to be put as the father on her birth certificate. Also he can legally adopt her if he is not the father.

Depends on the state and the age of the baby. In WI, you can change the baby's name, first, middle, or last, up to one year after birth, free of charge. After that you have to go to court to do it.

When you got the birth certificate from the state, you should have received a letter explaining this. If you didn't or can't find it, try contacting your county records office.

Is his name on the birth certificate? If it isn't, you can change the baby's last name when you file the paper to have the father added to the birth certificate. If he is on the birth certificate already, I believe you have to get a court order for a name change. Maybe contact your county's clerk of court, they might be able to help.

well i just went through changing my daughters last name. first you will need to go to family court and file for a noncontested name change. it will go through with no problems because both you and the father want her name changed. then you will have to send the court order of name change to the state. (in cali it is to sacremento) you also need to send 20$ with it, becasue they will send you the amended name changed birth certificate. be very careful not to loose this, because the only way to get the corrected birth certificate is to go through the state. i believe the name change costs about 300. (my lawyer did it, not sure on the actual price)

if you are not married you need to do paternity though the courts
