If they have done 3 years when asked do they have a criminal record they must give you full details, the police will tell you if they have when you fill out the relavent forms obtained from the local police station. Apart from that under the rehabilitations act 1982 they don't have to declare any convictions and it won't turn up on a standard background check.
Certain jobs that require a background check i.e working with children have special rules, again contact you local police station.
Oh and if you want the person to produce a background check you can ask them bear in mind there is a massive backlog it takes at least 6 months
