I would venture to say that if the title is still in there name, then you are screwed, that is unless you have receipts to show that you bought it, and all property belongs to you and spouse. Now if you just paid off the mortgage, which sounds like what has been done here, and they have maintained the title to the house, because it apparently has not been registered with the tax dept. Plz tell me you used a lawyer? If you didn't it is going to be hard to prove that you did not just pay to help them out and keep them from loosing their home. and too be sure, if you do include it your divorce agreement, plz tell you have no intentions of kicking them out of their home.....at least let them have life time rights to the home until all parties have died, or gone to nursing facility.

No i do not think so BUT i am not exactly sure. If it is their house then i dont feel that either of you have a right to it in this case unless the inlaws say who may have or live in it and then they would have to put that in writing and that would have to be sent to the courts to even be counted at all. They own the house and you guys just live in it. Contact a lawyer and make sure about all of this though. Good luck to you.

I don't believe it can, but may be wrong.
However, how dare you try for half of this house that was a wonderful gift to his parents.
I am sure there was no inkling of a divorce when your generosity made these gifts, for you to now try snatching back this has to be pure greed. Just suck it in and concentrate on your marital assets, that way you can still kepp your head held high.

No. It was a gift. The house is legally theirs (because it’s in their name).
Verify it with a local attorney.
