Yes and no. My fiance and I have been married in our hearts for three years. As far as our relationship goes, it counts completely in terms of fidelity, support and loyalty. But, we are going to do it officially because being committed emotionally does not count towards the legal benefits. Besides, why shouldn't you if you love each other?

If you are talking about common law marriage then yes you can. Only a few states allow for the establishment of common law, and some there are a few things you have to do to establish this sort of marriage.
Only 10 states in the USA allow for the establishment of common law marriage within it's boundries. They are: Alabama, Colorado, Iowa, Kansas, Montana, Rhode Island, South Carolina, Texas, Utah,Washington, D.C.
All of these criteria must be fulfilled for a common law marriage to be established.
"1: You must live together. 2: You must present yourselves to others as a married couple. Some ways of doing this are by using the same last name, referring to one another as husband or wife, and filing a joint tax return. 3: Although the time frame is not defined, you have to be together for a significant period of time. 4: You must intend to be married."

This may be this way in your heart and mind BUT it does not count as anything legally in the world's or courts eyes or even in God's eyes. It has to be on paper and sighned and a marriage license to be legal and to actually count believe it or not. Also you both wear rings and you also share the same last name usually that shows the unity and the marriage. It makes a big difference on how you apply for loans and how you have to file your taxes as well.

Count as what ? If it is in your mind and not on paper legally it counts for nothing...for health insurance , benefits, etc...it counts for nothing ....you have no legal rights to each in case of anything... but if you do not want to marry and just pretend..then it is worth the paper it is printed on

I was married for 12 yrs. and diviorced due to unfortunate circumstances. We were seperate for 28 months and are now liveing together again, we are not remarried but in our hearts we never divorced.

absolutly. In fact by law if you live with someone for 2 or more years they are your de facto partner and the same rules apply to divorcees if you split i.e half/half split.
