3 months ago, a guy told me he had friends in Europe and would offer him a place to stay so he would travel there. He said he needed a break and would like to take time off to travel. I thought he was talking about vacation. Later he really went to Europe and traveled for one month. During that month, I saw his mail box receiving State unemployment benefits paychecks weekly. After he came back from Europe, he just stayed home. Obviously, he had the intention to quit the job voluntarily. It might be possible to ask his employer to fire him but chance is rare. Is it illegal to earn unemployment benefits in his case? Where and how can I report?

Normally (at least in my state), when someone files for unemployment benefits, the employer is notified and has to agree that the employee was laid off, not fired for cause or quit. The employer has to pay for some of the benefits, so if the employee wasn't legitimately laid off, it's not in the company's interest to say he was and let him get unemployment bennies. Also, in my state, I have to phone in every two weeks and swear that I'm looking for a job by keeping records of every contact I made and interview I went on. Some states require you to fill out a form with names and phone numbers on it of job contacts.

Unless you opened the envelopes or your friend told you what he's doing, you might not have been seeing checks - just forms, etc. If you believe your friend is truly defrauding the state, call the unemployment office and drop a dime on him.

First of all, why do you care? Unemployment doesn't come from tax money; it is paid by his employer. Secondly, they check when you apply to see if you qualify (why you are unemployed). Lastly, you can report him, because part of the responsibility that goes with getting unemp. is to actively look for a job. Obviously, he wasn't looking too hard. They used to make you go in every week or two and show where you put in applications, but nowadays, I think you can just mail it in.

Could the checks be "disability" checks? If not, I think his employer has already fired him. I don't think you CAN draw unemployment if you quit your job. You can if you get fired, or are laid off involuntarily, but if you leave on your own, you're ON your own.

Collecting unemployment when not intitilled to it is Fraud.
