I was turning and was more than half-way across the street ( in fact on the other side) and was hit. The police said it was my fault but I want to know if I can sue mitsubishi because my 2001 Montero SUV's airbags did not go off. Nobody was hurt but me ( my children were in the car with me). I hit my head on the window but nothing too serious. I need to know if I can legally sue though for no airbags going off. I was hit in the front driver's side tire. It caved in the axle and I was not able too control the car. It completely destroyed the front side.

you could sue if you were injured because of the defect, but since you were not seriously injured there is no reason to. all you would be able to recover is the extra medical bills you sufferred because of the defect. you would have to prove you would not have been injured had the airbag worked before you could recover anything.

If the airbags had deployed you would have probably been injured worse than you were. People who are in accidents where airbags have been deployed often end up with broken facial bones (nose's being the most common) and scraped faces (imagine road rash).

The closer you sit to the steering wheel, the worse your injuries will be.

Most airbags are designed to go off at certain speeds, so you may not have been going fast enough.

You can always sue. The question is, Should the airbags have gone off? They are not designed to deploy in minor, low speed collisions. It sounds to me that you were involved in such a collision. If you were hit from the side, the front end will be destroyed in a relatively minor impact.

There is a possibility. You need to check if there is a recall on your make, model, and year for the airbags not deploying in this type of collision. If there is a recall, you are probably out of luck. If there is no recall, you may potentially have a case.

Yes, but depending upon your jurisdiction, your suit could be barred by the degree of your own negligence. The question is dependent on the state you live in and the comparative responsibility laws it has.
