Any song recorded on CD has a copyright on the recording. That is what the circle P is all about, and those are the rights the RIAA protects. They include recordings even if the compositions are public domain. I suspect that Myspace assumes that all music files were originated from copyrighted recordings, and frankly not a bad assumption.

Nearly all music is copyrighted but some can be considered public domain. Some artist allow their music to be uploaded/downloaded thereby giving up their copyrights.
