my ex has my things....but they are in storage with his items until he moves back to the states. i haven't heard from him in 7 months. does that mean I won't get my things back? they were some pretty expensive stuff. can i take him to court?

I'm in the same situation right now with my ex-husband, he is keeping pictures of my brother who passed away 6 years ago, and my brothers things. most of my things, i gave up on since it is materialistic things, but the sentential things mean the most. and yes if you have not heard from him in over 7 months, by all means hire an attorney and take him to court.

If you take him to court the first thing that you are going to be asked is WHY did YOU leave your things with him in the first place? If you didn't want them put into storage you should have gotten them out when he was putting his things into storage. He was not obligated to take care of your things. Guess it will be an expensive lesson for you to learn huh?

Sure, although depending on the value of your stuff you might not want to bother, since it'll cost you a lot and take forever. Your best bet might be to make a big effort to get in touch with him and ask for his permission to enter the storage unit... or maybe the two of you can work out an unbiased third party to go collect your things, if it was a really bad breakup. But keeping your posessions from you does count as theft, so actually suing him isn't out of the question.

Why not get a court order to have the storage area sealed by the people who run the place until he gets back and you can retrieve your stuff.

Of, if you can prove ownership, ask for a court order to have those items removed from storage.

I think you can take him to court, and at the very least, have him locked out of his storage until this matter is settled to your mutual satisfaction.

Send him a notice requesting you belongings. Give him say, a month to either write a letter to the storage facility in order for them to open it, or to come and open it himself so you can get your stuff. Tell him that if this is not done you are going to file charges of theft. Send this letter via CERTIFIED MAIL, that way he can't say he didnt get the letter, because he has to sign for it.
Yes, you can most definately go to court, but in my past experience, nobody sensible wants a theft charge on their record.

Make sure to give him ample time to get your stuff out, otherwise the court wont view it as him being an a**, it will look like you are unresonable.

You know what if he is keeping it cuz he loves to remember you and the good items leave the man alone. But if you think he is being mean and trying not to give the items to you to mess you up you can go to court. But how will you prove its yours???

I would say for you to leave the items with him if you go to court for this it might get more expensive than the item and the fight might get ugly.

You can't sue someone who is out of the country, so you need to wait anyway.

Are your things worth suing over, lawyers are very expensive. Remember they are not worth what you paid for them, but something much less now.

If you haven't been with these things for 7 months, why can't you wait? Doesn't seem like anything you need at the moment.

Best question: who would be stupid enough to break-up with someone and leave their valuables with them?

depends on if you can get into the storage thing, He might not pay for the place and your stuff will be auctioned off,
