some people tell me that i can not do that, that i have to give my child my last name then change it when we do get married, I live in FL. Does anyone no the law here. please help i have less than 2 months to figure this out.

you can give the baby whatever last name you want it to have. you do not have to be married for the child to have his last name.

I was not married to my husband when our son was born and I gave him his last name. He went by my last name only in the hospital. The baby has to match the mother on the ID bands. When you fill out the birth certificate you put the fathers name on there and then put what you want for the baby. I live in South Carolina and I have never heard of a law that says you can't do it. Good luck and name your baby what ever you want.

I am not sure of the laws in FL, I am from GA, but when my child was born he had my last name at the hospital and then when I filled out the birth certificate, I put the dad's last name and we aren't married.

I went trough the same thing two years ago. I did however get to give my son his "fathers" last name. All we had to do was show his valid drivers license to the nurse. I regret doing this though because I married someone that wasn't his biological father and we had to go to court and publish it in the newspaper for a month that we were changing my sons name. But if you are sure you want to do this then yes it can be done...at the hospital!!!! good luck!!!

In every state you can put the fathers name on the birth cert. and give the baby his last name married or not.If your married to someone else and have another mans baby by law you have to give it your husbands last name. If you give the baby the fathers last name he has all the same rights as any other father, he has the right to pay child support, he has the right to visition, holidays, joint custody, summer vocations, etc. If you end up married to someone else the new husband cant adopt him/her without the fathers say so.

Hey there! I live in Florida too, and when my daughter was born I wasn't married yet either, and my daughter took her daddy's last name. The father has to sign the birth certificate claiming paternity, though. They will give you some paperwork in the hospital regarding the birth certificate and you can choose then how you want your child's name to appear on the birth certificate. Congrats on your new baby, I'm expecting my 3rd and it's super exciting isn't it?

yes you can give them his last name, or anyone last name for that matter, i had my first daughter in Gainsville FL at shades and me and her father are still not married and she has his last name, but in order for his name to be put on the birth certificate he has to be present before you leave the hospital and have a picture ID, my boyfriend/ baby daddy had to leave and go back to work so my mother came and picked me up from the hospital so just this past year we got the birth certificate changed so her father name would be on it.

It depends on the state where you give birth. I had my first son in Wisconsin and was able to give him my boyfriend's last name (who is now my husband). Last November my sister-in-law was not able to put the father's last name on the birth certificate, she had to put her last name because they were not married. She gave birth in Missouri.
All states are different.
I would call your local birth certificate's office. The telephone number should be listed in the government section of your phone book and see what the law is in Florida regarding the state's policy.

Yes you can. I did it in Florida. The only time they told me it's a problem is if you were divorcing someone and you had the baby before you're divorce was final. Otherwise you can name you're baby anything you want. I didn't get married to her father till about a year after she was born. Both your names are on the birth certificate so you can have your baby carry his name if you want to.

When you are in the hospital, the baby will have your last name on it's wrist band for security purposes. However, when you fill out the SSN form and birth certificate forms, you can give your baby whatever name you want. I did the same thing since I have not changed my last name yet. The baby had my maiden name in the hospital but when i filled out her birth certificate forms, I gave her my husbands last name.

You list the father on the birth certificate then when you write the childs name down for the birth certificate you write the last name you want him to have. Either your or the fathers, it's pretty simple.
