My ex and I have decided to not go throught the courts for child support and visitation. Our Daughter lives with me and she goes with her dad when he has a day off of work and pays me child support every two weeks. Lately he has not been paying all of his child support. Know he wants to take her outta state for a few weeks. I don't have a problem with her going with him other than the fact I'm afraid he will leave and not bring her back to me. Is there anything I can do to make sure he brings her back since there is no court orders?

Do Not let her out of your site til you have full custody, especially if he has stopped paying child support.
I dont care how wonderful he is, you are not together and that is your little girl, as it stands if he takes her their may be no getting her back. you cant claim kidnapping and if you cant find him you cant take him to court after the fact.

He is taking an advantage of your trust. You are too trustworthy. This is why they have the court system for people like you. I would suggest you contact a lawyer, explain that you two made a deal about child support and that he sees his daughter, and then you explain your fear that he may take her and keep her. Apparently, something must have happened for you to be concerned about him wanting to keep her.
If I was you, I would do this ASAP. If there is no court order-GO TO COURT AND GET AN ORDER-and make sure he stick with it. Now,it is time to get the authorities on this. Or, your troubles will only just begun if you just lay back and do nothing.

If you are already divorced you should have the decree and parental plan stating child support and visitation. If you do, they normally state that the child can't leave the state with the other parent without written permission. If he then keeps her, that is kidnapping.

If you're not divorced yet, go to the courts and get a temporary domestic order, stating all this.

if i were you i would try to get some kind of court paper drawn up i would just tell him look this is my concern and just ask him is he plains on bringing her backyou know him maybe he is saveing some cash to go on a little vaca with her

This is why the court system was put into place to help with such things. You should use it.
