YOU OBVIOUSLY DON'T TRUST HIM AND HE IS ALREADY SHORT CHANGING YOU ON SUPPORT. GO TO COURT AND MAKE IT LEGAL. THAT WAY YOU HAVE THE FORCE OF THE LAW ON YOU SIDE IN CASE SOMETHING GOES WRONG.

First, you have to know that what you are doing is very stupid not only for you but for your child. Yes, he can take her and never bring her back and then where will you be? Never to see her again. Most states see custody as who actually has the child at the time if you do not have a custody agreement or court order as you put it. You need to get your but to an attorney or file for it yourself at the courthouse. They have people that can help you. I would not let him take the child out of state, period. Also, get to child support as soon as possible. It will not cost you anything and the check will be mailed to your or deposited in your checking account. You do not need to contact him at all. Do this now. This arrangement you currently have benefits him and no one else. Get going before you lose your daughter.

That is the problem with no court order, nothing in law without a court order to enforce child support,
with taking the child out of state what is the circumstance of taking the child out of state? is there any chance he will take your kid out of state in order to set up residency in another state?
if it does not sound right then maybe its time to get a lawyer and file for a order stopping him from taking the child out of state

Get to an attorney quickly. My ex pulled the same crap on me. We didn't go through the courts for child support or visitation beause I THOUGHT we could work it out ourselves. Eventually he stopped paying AND stopped seeing his kids. You're in danger of the opposite....sounds like he wants to take her. You've GOT to get a custody decree, or you don't have a legal leg to stand on if he decides not to bring her back. Do not let him take her. If he wants a reason, tell him because he's behind on child support and broke your "deal. In the meantime, get some legal help FAST.

Get a lawyer and file the proper papers for custody, child support and make sure you stipulate that he is not to take the child out of the state without your written consent.
There is nothing else you can do...you have to get everything in writing to protect your interests and those of your child.

You need a court order period. Without a court order you can't get any judgment of kidnapping or otherwise until a court has ruled that you have custody. You also need to file for official child support. Without it, its your word against his. And remember custody battles can take years sometimes. And if he does disapear...what are your chances of finding him quickly.
