No you are not married.

You would have had to call each other husband and wife and more importantly file taxes and do other business as husband and wife.

Its NOT just living with the person that makes you common law married.

Georgia does NOT allow for the establishment of common law marriage w/ in it's borders. You are NOT married to this woman.

edit:
10 yrs ago Georgia abolished common law marriage establishment, that would be right as you were getting w/ your baby's mother. So the answer is still, No.

Marriage has nothing to do with custody. If you are their father, you are still their father whether you are married to their mother or not. Why don't you get a stable home environment and become financially secure before you fight for custody. If you are going from one woman's house to another that is no life for children.

If you signed the birth certificate then you are the father doesn't matter if you are married or not. But I would tell your baby mama that you are taking them because she might call the cops.

I do not think any States recognize common law marriage anymore, at least in Illinois they don't.....
