Will my soon to be Ex-husband be able to get joint custody if...
he is a pizza delivery driver that barely makes any money,
lives in a 2 bedroom apartment but lives with 2 other men there( he is sleeping on the couch!)
I have proof he abandoned me and the baby at 7 months pregnant
and i have proof of his infedelity and a witness to it as well.
He is an unfit father if he blows his kid off to go on a date!!
he also gets fustrated with her and punches pillows.
but he does not do drugs and has not been to jail...yet
will this man be able to get joint custody?

I am a stable mother. i have my own succesfull business, i don't do drugs, i have never been to jail. I have payed for ALL of the baby's bills!
I am not in debt. both my parents are still married and i have a great family life!

No worries...you can get sole custody.......by the way, men ALWAYS try to play the "custody" card during a divorce...sadly, your daughter may actually see very little of this man in her lifetime. He sounds like a big mouth full of hot air making empty threats..typical. Keep your chin up, and concern yourself with you and your daughters needs.....you are better off losing this loser now, especially as he has shown his "true colors"....best of luck to you!

He may not get joint custody but he will get as much visitation as he wants. Just keep good records... times & dates of his missed visitation and anything else that you feel is unhealthy for your son to be around. The judge is going to base everything on proof not "what you think".
You can also turn the tables on him. If he wants joint custody than tell the judge that you will agree to it if your son will have with his father what he has with you, a home that is shared with his father and a space of his own. Not a sofa and two other guys.
In this case you need to use your smarts and what's best for your son. Not your heart and what would hurt him.

He will probably be able to get joint custody. The courts will look at the fact that the child needs a relationship with his/her father and since he does not have a criminal record they will see that in his/her best interest.

they always want joint custody when it come to the kids, but in reality its just a front. when i comes down to it, he will hopefully back off because it is too much for him to handle. regardless of what he did to you, but if you know he does not have a place for the kids then you could insist he has taken care of a safe place for the kids first. that should be your priority. you'll see if he really loves his kids or not. good luck!

If you have a really good lawyer, no.
Remember that many lawyers will just try to settle things quickly so that they can get onto the next case and make more money. Make sure that your lawyer is focused on your case.

It's not always about how much MONEY the person makes. I find it very intersting that you say you have a witness to his infedelity. What was this person doing WATCHING? Seems really ODD.
