what is the law on this. (smoking ban doesn't start to 30/04/07 were i live)

No, you are entitled to the same breaks as everyone else (assuming you are over 18 that is one 20 minute break if you work 6 hours or more). Other breaks, including cigarette breaks, are at the discresion of the employer.

Refusing breaks needed as a result of any health condition or disability or you could be a breach of the Disability Discrimination Act.

Definately not! I smoke, but i would never expect to be given extra breaks than a non-smoker! Think about it, thats pathetic!

You are not entitled to smoke at all when you are at work.
Your employer may allow this as a privilege.
