No it's not a crime. The flag should be lighted at night though. If not taken down.

there was a flag code set up to protect the flag and for the proper ways to honor the flag
a flag flying at night from a pole should be lit up- that is a light that is purposly put on the flagpole... not with a street lamp near the flag.
otherwise the flag should be taken down at sunset and put back up in the morning.
im a Brit but i did notice in the USA alot of violations of the flag code different violations but across several states. seems most people do care about the flag code but there are some people that let it slip and think they are supporting their country by flying a ragged flag from a tree in their backyard. in my view they are just to LAZY to sort it out... if they are going to show their patriotism they should do it properly or not at all.
i mean im not perfect myself... i have let my flags drop on the floor now and again but INSIDE and as ACCIDENTS not a blatent display of laziness and downright disrespect toward the flag for the world to see outside!
light it up at night or take it down!

No.. but it has to be properly hung and properly lighted at night.. (a fact that 99% of people fail to recognise and adhear to)
I love busting super patriots nuts on this one.. there is actual law and regulations on this only 1% of people actually follow that law (Hey dont blame me only flag I fly is the Jolly Roger( seriously).. thats where my alliegance is pledged to)
More people in the USA violate flag regs than not actually

It is'nt a crime, but a veteran or extreme-patriot could be very offended if the flag is not lit at night. It is about tradition, not law.
