Do you mean legally? Or morally? Here you might find the definition. Former President Clinton said oral sex was not sex (I did not have sex with this woman) so go figure it out:

of course it is. it is not intercourse, but it IS sex! for the record, you CAN go home with some STD's after an encounter with oral sex.
