to the U.S. to face prosecution in a court martial?

canada and united states has "extradition treaty", so any american wanted citizen civil or militia have to be repatriated based on the protocols of the agreement...countries like russia and china, US does not have any treaty to repatriate wanted citizens. that's why US was flooded by chinese who are seeking assylum, so is china can't turn over a wanted american citizen to the US authorities unless china will act in goodwill expecting US to do the same.

Deserters are not the same as draft dodgers, I think that would make a big difference in how Canada dealt with them. However, I don't think that is a problem. It is the Liberal Hollywood stars that claimed to be moving to Canada.
Jimmy Carter forgave all the Draft dodgers and let them come home without being prosecuted. Well, he gave away the Panama Canal as well. At least we shouldn't have to worry about Jimmy any more, just Kucinich, Edwards, Clinton, Obama, Gore, and Dean. Did I forget anyone?

They deserted a VOLUNTEER ARMY! They were not conscripted into the military. At the very least they should be locked up. I'm not a fan of things our government have done, but if one joins the military for the GI Bill and the educational opportunities it offers, and when the person gets out of the military, the government decides, "We're not going to give you money for your education", I bet they would be highly upset. If you don't want to fight and kill others nor want to be wounded or be killed yourself, that is fine. DONT SIGN UP! It's that simple.

There is an agreement between Canada and the USA that states detesters cannot be granted refugee status, those they are considered illegal and if caught will be returned to the USA to face any charges.

They joined the Army of there own free will .
There is no draft in the United States today ,they need to be returned and tried and if convicted sent to JAIL .

That's up to Canada; if I were them I would not want to harbor any fools who sign up for a job and then decide they don't want to do it. It would be a different matter if they were impressed into service but thankfully that has not happened yet.
