great thought. why cant a women choose to kill herself is it not her body? why is the same woman who can choose to abort her kid as its her body cant choose to smoke pot isnt it her body?if a doctor kills a baby its called abortion if a doctor kills a 80 yr old lady its murder?

Great question and hopefully it will give the pro-choicers something to think about. The Lacy Petersen (sp?) case is a good example of how the law..at least in California..deals with the murder of a pregnant woman. The fetus is considered to be a living human being so when Scott Petersen murdered his pregnant wife the law saw it as a double murder.

To be charged with two murders, one each for the mother and the fetus, the court must determine whether
the fetus was 'viable' (capable of surviving outside the womb).
So, the murder of a pregnant women could result in only one charge , with the fetus receiving no legal recognition.

I see from some of the answers that apparently they think it isn't murder if you choose to kill a baby but is murder if it was done in cold blood. What about the babies choice someone has to be the spokesman for the innocent "murder" victim and in our society I believe choosing to murder is still murder. Abortion is premeditated murder. According to the pro choice argument I could "choose" to kill somebody and it would be alright. What if I chose to pull the plug on your grandpa when he is fighting for life or what if I fatally shot your grandma that is dying with cancer but still has 6 mo to live......is that still justified murder.........no it's not

It is a womans choice to abort or not.... A man who kills a pregnant woman has taken that choice away....no one knows if she was going to carry the baby to term or not...therefore it is murder.

Well a baby is not fully conscious until he/she is 5 years old. So the charge on the baby should be less (I'm not siding with murderer =S) Oh jeez I'm so bad at these philosophical and law and order questions
