i had cts surgery and was on workmans comp for awhile. i have a very physically tough job. after surgery i returned and went through many painful months before it started coming back full blown. i opted for fmla leave for the anxiety depression it caused and didnt return by fmla deadline and was terminated recently. i am still very depressed and having panic and unable to work right now for both reasons. am i eligible for unemployment? if not what other options do i have? have been thinking about checking myself into mental health institute for right now and suing workmans comp for not being able to do my job anymore which was really good and can not do any job im qualified for. i was offered a 10 dollar an hour paycut on noghtshift. i would settle for unemployment to not have to go through the stress of the workmans comp battle as my mental state is bad shape right now. any advice as of what to do?

First of all life is as good as you make it, yes it does suck sometimes but you need to make the best of it and be grateful your alive, Secondly take any kind of work you are capable of doing even if it is a small amount being around others or out and about will help your mental state, I'm sure your state of mind starts to get cloudy when your cooped up, hurt and out of work for a time, And yes that would make me angry about my job doing that, these days people don't care about others when it comes to jobs they think all well replaceable. Try and make the best of it, I'm against mental institutes because i think some things are mind over matter, talk to a counselor before resorting to that. Good luck I will pray for you!

Its not clear from your question if you maintained contact with your employer regarding your medical status or simply failed to return to work. If you failed to return to work without contacting your employer, you have no rights. As far as they are concerned, you quit. If you did stay in contact, they are only required to maintain your original job for however long the FMLA act currently requires, after that, they can offer you whatever position is available. If that is the case, refusing the job offered means you quit. Without additional information, you may not be entitled to unemployment.
