After being fired from mishandling funds, the company i worked for hired an independant autdit, and then filed claim with their insurance company. The insurance company send me registered letter asking me to call and discuss an accused $96000 discrepency of funds. I was given advice to not call and to wait to see the insurance company next move. I dont know what that will be or when that will be and it is making me sick. What is the best way to proceed. The audit was over 3 years and started because I admitted to using income and business checks to pay off old accounts receivable so i would not be in trouble adn get yelled at for not getting my job done. I also cashed three checks totaling under $2000 but I re deposited and returned that money. I know it was wrong, I lost my job of 15 years because of it. My life was feeling out of control for those 3 years. Marriage in trouble, mom living with me, brother always being a problem, was drinking, depressed. I did wrong. What do I do next?

1. You should go ahead and retain an attorney. Now the keyword there is 'retain'. That just means you have hired him just in case. By having an attorney on retainer, if you get arrested, it will be more likely that you get a low bail and don't even have to wait in jail for a hearing.

2. Do NOT talk to the insurance company. Do NOT admit anything. Do NOT EVER talk to them telling the story you just did about cashing checks then returning the money. Since the money is there, do NOT VOLUNTEER GUILT.

3. Silence (the 5th amd) is your best friend here. THINK!!! Even if money is missing, they have to PROVE YOU TOOK IT. Do NOT OPEN YOUR MOUTH! Don't go in there talking about how bad your life is right now, how sorry you are, etc.... if you do they are going to nail you to the wall and use you for target practice.

I agree with the av ice to let them make the next move. No charges have been filed against you. By no means call them or have any contact with them. If you are in the situation you explained with very little money then wait until they start proceeding against you to hire an attorney. If you have paid all the money back and the rest is accounted for your troubles may be over. It would not be cost effective for them to go after you for more than they would pay their attorneys.

The insurance company is conducting a "fishing expedition."

They have your name on record as misshandling funds in the past. They want to find a scape goat they can prosecute, and get a settlement against.

I would pay an attorney a retainer fee, and have him send a Notice of Representation to the insurance company if you are served any legal documents from the insurance company, such as a subpoena or Complaint.

Until then, enjoy life, and don't worry about it; you have no legal obligation to respond at this time.

You need an attorney about 10 or 15 seconds before you think you need one.

Actually, attorneys are for the innocent, not the guilty. An attorney representing a mass murderer who confessed to the crime will cause that attorney to loose only the minumum of sleep.

Innocent people worry attorneys more than anyone.

Innoncent or guilty, the attorney's job is to protect your rights. The answer is, everyone needs an attorney, the moment they are accused of any crime or has been issued lawsuit papers.
