someone i know was in the army and had a stamp to say he was okay to stay here but then got discharged from the army and he went to see a solicitor couple of years later as the army didnt tell him he had to go home and the solicitor said he was classed as an overstayer he has now gone back to his country but he is going to marry someone who is a british citizen as they have been together 4 years will they not allow him back when he applys for the visa to come to uk as a spouse because he overstayed?

Hmmmm...despite the wealth of information you provide there are uncertainties here - especially concerning the stamp in the passport. It was probably an exemption stamp and these are complicated - and I can't be bothered to go and look them up right now.
However, in short, to enter this country as a fiancee or spouse one needs to get a visa from an British Embassy/Consulate or High Commission. If this person is upfront about their UK history then - if the marriage/relationship qualifies for a visa - then there is every likelihood that it will be issued.

OK - I've bothered to look it up. Basically someone who joins the army would normally get a stamp from the Home Office making them EXEMPT FROM THE CONTROL. After they leave the army they should submit their document to the Home Office so that exemption can be withdrawn and substituted with 28 days leave as a visitor. If this is done and the individual does not then leave (or apply for an extension) then they WILL become an overstayer. However it would appear that it is NOT an offence to fail to declare that one has left the army. If this is indeed correct then the individual of whom you speak may NOT actually be an overstayer - though if they ever left the UK and re-entered on the exemption after they had left the army then they would be an illegal.
