Hi, I was recently hit rom my motorcycle by a totally inept "senior" (don't ask me why) citizen. Essentially he took the left hand lane, even tho he had the intention of turning right. I was turning right, in the right hand lane. One mistake done. Upon being adjacent with the right hand turn he didnt make any observations and pulled into the right hand lane. Hitting me off, into a lampost and causing severe brain injury. The police have sent me a letter saying how "they will not seek to prosecute any party" in relation to my accident. Anyone know of ways in which I can settle the anger filled stomach by persuing this case and hopefully getting his punished? even something trivial is GREAT. Just anything to cause this Old age Moron a loss from the whole thing.

I think that you have the "Moron" part right but just because someone is old does not mean that they are stupid or bad drivers. Idiots are all over the roads and unfortunately not many drivers give two-craps about motorcyclists.

I say use the Internet to shop around for lawyers and watch personal injury commercials on TV. On-line yellow pages are great too. Try looking for people in your area that have had similar cases and how successful and speedy was their outcome.

Don't be afraid to shop around and don't jump on the first lawyer that comes along. Get familiar with the statute of limitations on a case such as yours. Keep at least 2 copies of all paper-work concerning your case (medical records and bills, auto repair bills, police reports etc..) if you have to give out any copies, make yet another set of back-ups.

Good luck and swift recovery. :)

I would think that his age shouldn't have anything to do with it.. if he tried to make a right from the left hand lane without looking and hit you, yes it was an accident but it was also careless driving. If the police won't even ticket him (and they wouldn't prosecute for much more unless he actually intended to hit you), perhaps you should contact a lawyer and see what they say.

drivers under 20 and over 70 should be not allowed or maybe limited to driving. drivers here have opened up more drive through banks and restaurants mistaking gas for brake more than once. young drivers drive like they re bullet proof and usually kill the other driver for their own stupidity

Not necessarily all of them as some are pretty good too! As the saying goes, 'old is gold'!
