The father of my 14 month old has never given us a cent, has seen his child only once - now is threatening that if i take him to court for child support, he will go for custody. Does he stand a chance? now i am scared to take legal action as i dont want him anywhere near the baby....not even visitation.

Don't worry, he will not get custody. He obviously has no clue how the process works. Absolutely file for child support. He will go to jail if he won't pay it. File for the back child support that he owes you also.

Well, he is the father and has visitation rights. He also must help support the child.

You must decide which is the most important; that your child receive the financial support he needs or is your anger most important.

You cannot decide if the father sees the child or not..he has the right already. Take him to court, get an order for support, make arrangement for him to see the child and get over your anger.

If the father is unfit, then the court will decide the fitness, will decide to order supervised or unsupervised visitation - or no contact. Keep in mind, the court will decide based upon THE BEST INTEREST OF THE CHILD - not some petty anger you or he might have towards each other. It is not about YOU, it is about the child.

which country you in laws vary but usually the mother will always win any custody battle all it boils down to is the best for the child if he was abusive and the police have been involved he has no chance in hell any lawyer will bring that up in court the best thing to do is get a custody order before he does 99% of child cases are awarded to the applicant and use what ever you can against him I am a father fighting every day to see my children but in my case i have nothing to fear from the law she is just doing what is best for her not the kids keep fighting and do it now for the child's welfare

if he is a bad guy then he will not get custody over the child. I think you should try to get child support because im pretty sure you deserve it

Absolutely not. Especially since he doesn't exercise the visitation he already has. You definitely have the right to go to court for support without any fear of repercussions.

If you have a job, do not do drugs, I do not see how he could. But ask a lawyer as well.
If he pays child support, he will have visitation rights.
