I told my ex (soon to be officially) husband that I wanted a divorce the first week of January. We jointly filed the first week of February. Per the divorce agreement, the house is mine, and he signed it off right before we filed for divorce. So it has been almost a month, I had to serve him with a 30 day notice to get him to understand that he has to find another place to live. I have not been weak, I have been completely honest with him and have told him that he has to leave. I am at a total loss, and I am really sad that I become nauseous when I commute home in the evenings because I know he will be here. I want him out now. What can I do?

If you have served him with a notice, you can probably go to the local city court and do an eviction proceeding. You get the order of eviction order; he gets a few days; if he doesn't go, the sheriffs can come and make him leave. That's the way it usually goes, at least - you should talk to your local court clerk or an attorney.

Goto WalMart or a nearby hardware store and buy NEW dead-bolts and/or locks for your door. If you don't have any tools, be sure to also buy a strong screw-driver to take the old screws out of the door. If you have never changed a lock before, look in the Yellow pages of your telephone book to have it done SOON. Then, either leave his PACKED items in the garage and change the lock on the garage door that goes to the house and let him know that they are stored in there (I bet he has a garage door opener too)... But, if you change the garage lock that enters into the house, he can't get in at least. Then, if he still hasn't picked up his stuff, the other thing you can do is move it to a storage facility or donate it to a goodwill store or Salvation Army (they have free pick-up in some cities).
He is not wanting to move out, that is why he is still living there. He doesn't want to make the BIG move, but he must be forced to since you two are already divorced.
You might be able to call you local law enforcement and tell them of the situation to see if they can offer any suggestions. You have a court order saying that the house is yours, so there is no need for him to be living there. He is taking advantage of you and doesn't hear "NO" when it is said. Anyone that doesn't hear no the second time, is trying to take advantage of you.

talk to your lawyer about the divorce decree and call the police
you gave him the 30 day notice did you keep a dated copy of it if not reserve him the 30 day notice and date it and have the local sheriff serve it to him or local police but do not kick him out and throw his stuff in the front yard as you could get into trouble for that legally mostly sounds like a local matter for the police department to take care of file a restraining order also against him so if he returns he is at fault make sure you cover all your bases so he has not recourse on you that you kicked him out and left him homeless and damaged his personal property
maybe that's what he is trying to do to get you into trouble
sounds like a scum bag to me that he is still there and just wants to make your life miserable

Change your locks when he leaves and lock the doors and do not let him back in. Change your phone number as well and by the way if he has 30 days wait till that is over before kicking him out. Also pack his stuff and he may start to get the hint. If after 30 days he is still there pack his stuff put it outside and change the locks. He will get the hint real fast this way lol.

Call the police, have your papers in hand and make sure they escort him from your house, make sure he packs his stuff...and CHANGE the locks on all the doors and if you have a garage door opener, change the settings on that too... (if the police in your area don't do that sorta stuff...call the sheriff's dept...they will do the same thing...just make sure YOU have your proof out so they can read it...)make sure your ex has taken the garage door opener out of his car and surrendered his house keys, ALL of them...(but still change the locks)

you don't have to do much. if he signed off on the papers, and you gave him 30 days notice, wait the 30 days, call your lawyer, and have the police remove him.

You may have to get the police involved.

Perhaps talk to your attorney (not his attorney) about what you can legally do to have your husband removed from your house.

If your husband is abusive and dangerous, then I would go directly to the police, but don't let your husband know you are doing this.

if you served him the notice and its been past 30 days and he still wont leave call the police. they will make him leave and escort him off the property.
