My best friend Jill is leaving and will be getting a divorce from her husband, Jim. He wants to file for divorce before *she* does because he doesn't want to admit that his wife filed first or that she's leaving him before he leaves her (she has purchased a house, she goes to settlement this month).
He claims that he's going to put as his reason for wanting a divorce is that she and I are having an affair. (I am a female.)
Frankly, the reason that she spends so much time with me is because she doesn't want to spend time with him, as he is an alcoholic and never pays attention to her (there are other reasons that I won't get into). That doesn't mean that we're sleeping together.
He has no proof that we are having an affair (there's no proof because we aren't having an affair, I love my husband and won't cheat on him with anyone, not even a woman).
Here's my question: will I have to go to court and defend my sexual orientation?

Thank you all for your answers to far. I plan on being there for her at the 'trial' or whatever, but I meant will I be forced to testify about us NOT having an affair. :o)

Ohhhh Ive been there done that....
He even told my kids I was a lesbian and cheating on him...
tried saying that's why I "made up" him abusing my daughter and made her go along with it....

But really... dont worry abotu it... most judges dont have the time to put up wiht that crap...

When they get divorced the judge will snap at him for trying crap like that.

However, get your friend a support group and help her pick out 1) a good lawyer & 2) a counselor.

And I thought Johnny Cochran had a good defense with his "If it don't fit, you got to aquit." Damn, never thought of the Lezbo defense, but he's pretty ambitious for even having the moxy to try and use that as an excuse. It doesn't matter who files first, the other person can file an answer witht he court, so she can just file her answer of "he's a nutbag!" and get on witht he seperation.

probably not, ... 98% of all divorce cases settle before a trial. When filing for a divorce the options for filing are... iIrreconcible Differences and Incurable insanity (which is rarely used)...

different states have different laws so without knowing where you live i can't answer with any amount of certainty. i will say being as there is no proof of an affair it probably will not come down to you having to defend your sexuality

I am pretty sure that courts don't have time for drama. And this is just egotistical drama on HIS end. I'm pretty sure you won't be dragged into court. I wouldn't worry about testifying. But be sure to go as a support for her.

I wouldn't worry about it. He's just an immature loser. I wonder if he could be charged with perjury if he tells that bs lie. I'd actually like to see this case on one of those court shows... you know, like the kinds that go before the judges like Judge Judy. I'd like to see her rip him a new one.

i don't think the courts bother with reasons for divorce anymore, most states have the no fault now. he is just trying to find reasons to make himself look batter, because he is unwilling to take any blame for the breakup.

You might if he truly uses that as his reason. Some people will do anything to "look good", won't they? Good thing she's leaving him, he seems very immature!

WTF.. if he is looking for an excuse that is a lame excuse!!! I don't think you should be sayin "dragged" into this. She is you friend and you care about her... so you should be there for her. Regardless all the matters is what really is the truth.
