MY SON WAS ACCUSED OF DRINKING ON CAMPUS AT HIS HIGH SCHOOL, THE GEOGIA STATE PATOL WAS CALLED AND SHE SAID HE REGISTERED .008 AT 10.08AM I WAS CALLED . HE SAID HE HAD JUST RISED HIS MOUTH OUT WITH LISTRINE FROM BREAKFAST. I TOOK HIM TO HAVE A BLOOD ALCHOL TEST DONE AT THE DR. AT 3:15 AND IT WAS NEGITIVE FOR ALCOHOL. NOW HE IS OUT OF SCHOOL FOR THE REST OF THE YEAR. WHAT SHOULD I DO. ANY ADVISE?

I think you mean to say his blood alcohol level was 0.08 ... unfortunately, depending on your son's mass and individual metabolism, it's entirely likely that he would've cleared any alcohol from his blood by 3:15pm if he was only at 0.08 at 10am.

Listerine could make you false positive, but in general only if you took a breathalyzer in the minutes right after you washed your mouth with it - probably not hours later.

If your son is truly innocent, then the only thing left is the accuracy of the breathalyzer that was used, it's calibration or the skill of the person who adminsitered it. You'd probably need a lawyer skilled in defending DUIs, or somethint to that effect, to help you fight the school district.

bring the dr. report to the school. blood tests are more reliable than a breatholizer. my bro, due to alcoholism and to many dui's, had to have the bretholizer put in his car. couldn't start it til he blew. his registered alcohol after eating a halls cough drop. keep on them about this. expelled from school is to harsh especially since you have a dr's report.
