you won't goto jail unless you are on their connection using it hours on in.
Cover your tracks though.
Net+=stumbler - active search (minus the +=)
S??Mac - change your network device MAC address
stumbler has a api and you can use google maps to customize listing

just fyi, snooping and logging in to a wi-fi network without permission, even if the connection is 'open', will net you 5 yrs in prison in the US if caught.
the practice is called wardriving, i suggest you look into that for what you are looking for
