First of all I want to say that I am so sorry this happened to you :(
I read in Essence Magazine about a woman putting her rapist in Jail! She had done year after it had happened.
She had contacted the police for some other reason, and asked the person is it possible to convict a rapist after it had happen so long ago. The person told her that she could and that she had to get him to confess. She eventually got him to confess on the phone. He came up with some lame excuse that he had been traumatized in the war and couldn't help himself. Needless to say he got thrown in jail anyways. She was between the ages of 3-14 when he molested her, and she was 30 or more when they convicted him. I will try to find the article for you if I can. She was 38 when should shared her story with Essence Magazine.
I support you so much. You should be nothing short of infuriated!!!!!!!!!!!!!!!!!!!!!
I believe it is necessary to have him locked up so that you can heal and so he can too. Remember that guy who claimed he had raped some of his family relatives 20 years ago, and they he raped 10 students in that Amish Community? Do you remember that? Also we need to let other young ladies know that this behavior is completely unacceptable for any reason always. I would tell if I were you no matter how long ago it was. I would also want my daughter to. I hope sharing that woman gives you perspective and courage to do what is best for you.

I am rather weary of living in such a litigious society myself, so I can hardly be expected to encourage you to sue him. I mean, how much money will it take to make you and your husbands problems disappear, you know, and if there is an amount, what were your problems really? BUT! if you're talking about prosecution. . .I would say first, before you do persue that course of action, ensure that it is warranted.
I am by no means defending child molestation. In my opinion, a person capable of such capricious violations of another is no different from any other mad animal which needs to be put down. I would have no hesitation doing so myself, fully accepting whatever came of my own actions . .but I am constantly being reminded that redemption is possible.
So what am I saying. . .Find out what they are doing now, are they currently listed in a database of predatorial sex offenders? If so, definately prosecute, get him off the streets and away from anyone elses whom's life he can ruin, but who knows, twelve years is a long time. Maybe he's out there seeking atonement for his past transgressions, maybe he succumbed to guilt and committed suicide, I mean, virtually anything is possible.
As for seeing a psychiatrist. . .Talking helps. Friends speak with one another, parents, siblings. . .everyone. Communication is the cornerstone upon which all social interaction rests. It can't hurt, and medicare will cover it in the case of low income individuals in need if it is just a matter of money. A psychiatrist may not be able to heal you, or even help you, but perhaps just explaining what happened and how you feel with someone you can trust not to violate confidentiality will help you focus on your adversities with enough clarity that you can make your own restitution and come to a peaceful resolution.

For criminal charges, the statute of limitations on crimes committed against minors usually starts at 18. So if the statute of limitations is 3 years in your state, you could probably file charges until you're 21.
For just suing the guy, I have no idea. Either way, do what you can to make sure it doesn't happen again. If you were 16, and he was 18, that's not much to worry about. But if you were 5, everyone he knows needs to be warned. People like that don't get better. Ever.

From the sounds of it, suing someone for money is not in any way, shape or form going to help you psychologically. You need counseling.
As for criminal charges - (or even a law suit) - I don't know what the statute of limitations is on such a thing, and to prove it you either need the person to admit it in front of a witness or in writing. Tape recording without the person's knowledge would be thrown out of court.
One other possibility of proof is if the freak has an identifiable birth mark or scar on his private area that would not be seen without him being naked.

You could try but the chances of proving it are slim to none. If you don't want to see a psychiatrist then talk to your husband or a close friend about it if you don't want to reveal this to a complete stranger. Good luck and these things make us stronger girl. Don't let it consume you and live your life. It's hard, but you can do it.

I was also molested years ago but I got help right away. It depends on your state's laws. I had hard evidence as well. There is alot to it. The process itself was actually traumatizing to me. He had multiple accounts on me and only got charged with half of them and then to top it off only served half his sentence.

You could try, but the way our courts are set up there is a good chance that it will fail. There wouldn't really be any medical proof after 12 years.

Nope, you sure can't. You are past the statute of limitations, which is 7 years. I suggest you start counseling immediately so that you can move on with your life.

its not about sueing, its about putting the person away for doing something wrong.
You can still build a case, recently a women in England put her molester away 16 years after the fact.

when I was six my brother was 4 this man told me and my brother he had candy so being young I went he molested me then my baby brother I was tryin to make him stop as soon as he was done I told he went to jail but want to know if he is still locked up if he is out I want to sue his *** and and state who let him out it was bad what he did to me but what he did to my brother infront of me sorry want to confront him tell him off and more but I was raised better then that
