I am not anti-semitic at all, I was just wondering if it was considered illegal to wear a swastika or to have a tattoo of one.

It is not illegal to wear a swastika in the United States. It is a matter of your first amendment right to freedom of expression. I would suggest you think long and hard about getting a tattoo of one or wearing one. People will automatically make the assumption that you are anti-semitic and support the Neo-Nazi movement, whether you do or don't. Personally, I would not hire or do business with anyone who has a swastika tattoo, and I would be well within my legal rights to do that.

Your right to free speech allows you to wear it. There is no law against it. Depending on where you are going and what you are doing it may be in poor taste and could cause problems. IE if you go to a Jewish area wearing it you could face problems for inciting a riot. So wearing it alone is not a problem, what you do while wearing it could be. You also open yourself up fo rpeople who do not see it as a halloween thing but think YOU think that way all the time. It sounds like your friend is already on that path.

I have never seen anything in writing that it was against the law. It may raise concerns among others, but being against the law, I don't think so. During elections there are sometimes people running on the Communist Party ticket, and I thought a swastika was a communist emblem. After all, isn't that what America is all about, the freedom to do what we want and hopefully not be discriminated against for our beliefs, tatoos, or whatever?

Kids get in trouble for drawing the swastika in school, but i'm pretty sure it's ok to wear a swasticka in public, but some people might not like it as much as you do, so you might want to watch your back

It is a damn shame that the symbol has been so tarnished. It s all around the ancient world, but now it meaning has been perverted. Personally, I think it is an amazing symbol, not of hate, but of good fortune and well being.

It is not illegal. It has limited protection under the First Amendment.

However, if you wear one, and it causes a riot, you could be arrested for breaching the peace, among other charges.

I know it's not illegal to display it (like a flag), so it's probably okay to wear.
But it is illegal in Germany. Weird

No, that would be most unconstitutional!!!!! Though I think it is in Germany, oddly enough the Swastika is an ancient symbol of budhism and hinduism.

Not at all. However it may be against certain dress codes and that those are acceptable. The ACLU can help you out with that question.
