why is it that women get custudy atomaticly when the baby is born

For once, I have to side with the man on this one. Yes the mother can breast feed, most of the time, but there are now formulas available that provide the same benefits that breast milk does. The baby's welfair is most important. If that means the mother should have it then so be it, however, if the father has been an active participant throughout the pregnancy and is in the best position to care for the child then he should have the child. In either case, unless there is good cause not to, the custodial parent should make every effort to involve the non-custodial parent in the baby's life. And yes, I am a single mother of two children and no I am not insane. ;)

Because she is the mother. She spent the last nine months carrying the child and gave birth. Can a father breast feed a newborn? Mothers (good ones at least) have a special bond with a child that comes from the pregnancy. A woman can feel a life growing inside her and falls in love with the baby before it's even developed, the more the child grows the stronger the bond. The baby also hears the mothers voice and knows her before birth.

Unless the mother is unfit, she will have custody until a court date is set. Even then, unless she is a bad mother, it is extremely rare that a court would take custody from her.

mate were do i start on this subject. to start with i don't know how old you are or if this is your first child but let me tell you one thing you have a long way to go.

i was married for 7 years with two kids and she cheated on me now she has the house the car the money the child support etc.now you tell me does that sound fair when she was the one that stuffed the relation up.

the answer b4 about that they are the mother and they can nurture the baby i say what a father cant nurture a baby as well.if i could not nurture a baby i would not have one.

i fell really sorry for you mate as i know the heart pain of court battles for children and it really sux but unless your ex has some drug problems or something Else that might stop her from raising the child properly I'm sorry you have no hope with this law the way it is this day and age.

the biggest thing that i hate is that children aren't a car or a piece off furniture they are human beings and the children have the right to have the loving off both parents except for some examples eg drugs and paedophiles.

I believe the decision is made in the best interest of the infant. With regard to your situation, I believe it is because when a child is born, there are things he/she needs that can only be provided by a woman. An example would be breast milk and the love of a mother. Most experts agree that a baby is best cared for by the woman who bore him/her if at all possible. During a situation where both people want the child and both parents are fit to be parents, they leave the child with the parent who is better able to support them, school establishment or anything that would be least interruptive to the child's life are considered, until decisions are made by a judge that indicate a permanent arrangement.

Well, she carried the baby inside her and hence, is thought of the first primary caregiver, given that she can nurse the baby. It's always been this way as far as I remember. I'm not sure if it's the case for an unfit mother, such as a woman who entered prison while pregnant, or a mentally disabled person who cannot care for anyone else, or a mother who disposes of her unwanted baby right after birth. I'm sure in those situations exceptions are made. That does not exclude the importance of a father.

Well mothers are the first primary care providers and sometimes when they breastfeed, in some cases it is the best choice for the baby...Plus she carried the baby FOR NINE MONTHS RIGHT?! Unless the mother is some doped up drugged out, ..or alcoholic you know scumbag... then maybe the father has to be the most super father figure of them all...That' so unusual. so if you think you are much better then the mom so go to court prove that you are far better so do it!!

Because the people that made up these INSAINE RULES have mothers in their life that where normal, and nice. Millions of women are not that way unfortunately. Men can be nurturing, you don't need **** or a vagina to be nurturing. Breast feeding doesn't usually apply when a pycho woman gets primary custody, They don't have the kids best interest at heart, so they aren't breast feeding. It sucks

No it is not fair! but it is up to the Judge that receives the petition for your divorce. The lawyer you hired should have been told to make the Judge aware of your desire to have temporary custody of your child. The Judge then might have allowed it, My lawyer stated that if the woman wants custody, she will get it unless there is some proof that she is mentally or physically incapable of doing so.He also stated that I could spend $60,000 to $600,000 and still not retained custody. unless you can prove that she is unfit there nothing you can do till the court has a say but for now you need to step up and show you are a good father by making support payments and going by and visit the child. that's the only thing you can due for now. i have to also say if you can prove she is not good mother the court will award you custody to you. good luck....

Yes that is normal about anywhere you go. The judge will normally award custody to the mother anyway unless there is a MAJOR problem. Good Luck
