If a phone has a "voice activated dialing" feature, do you need cingular's voicedial plan to use it?

Cingular has a feature that they charge for that, but when I was on Cingular I had the D807 and it had a voice command feature I used it all the time, and did not get charged. The way to get charged is if you dial *8 and use that voice dialing feature, the numbers are stored in a central server not on your phone, the benefit to that is that if you loose your phone or change numbers you wont have to do a phonebook swap, but using the SIM card and the phone's voice dialing feature there is no need for the *8 service.
