All music is copyrighted.
Well, unless it's some nobody that isn't signed to a record label.
If you download it from a program such as limewire, it's illegal.

Chances are that if its been on an album its copyrighted. However good news is that the RIAA tend to go after mass uploaders for the most part. Its still a dangerous game though. They've pushed pushed new legislation through that says you aren't even able to make backups of CDs that you actually own for archiving. So be careful. On a side note, if this is a big label song I don't have any moral issues over "borrowing" their music but if its an indie label this really does harm the artist more than you might think.

99.9% of all music being transferred between P2P sharing is copyrighted.

If you don't don't want to worry about it don't break the law. There is no safe way to steal music.

I wouldn't recommend using illegal methods to obtain songs. But if the song is on iTunes or another major music service, the song is almost always copyrighted. If you're looking for free, legal songs, music.download.com has a good selection.
