You'll have to pay it back, but generally as long as the reason for overpayment wasn't fraud they won't ask for penalties and interest. The key is going to be if you knew, or if anywhere on the forms you signed they made mention of other benefits and you decided to ignore it.

Also in some cases as long as it you weren't trying to defraud them they can waive repayment if it presents a hardship. Better not have been taking trips to europe, buying new cars, etc if you're going to try and get them to approve this.

Bottom line as long as it wasn't intentional they generally will work with you. They're more concerned with the guys defrauding them, who take tons more then you could ever imagine.

To those who say you can't not know yes you can. I was eligible for SSI benefits under my father (didn't know I was though) who I didn't live with. He decided to claim them for me (I never got any of it) since they where being based on his disability. I then got into trouble when I got workers comp because they said I lied about getting assistance. Once they checked they realized that yes I had gotten assistance, BUT it went to my father who had applied for them AND that not living/talking with him I had no clue he had done so. Bottom line it is possible to be receiving benefits and not know it, especially if someone else can file the claim legally (as was the case here) for benefits regarding you.

It's a bit difficult to understand how you did not know you were receiving other benefits. However, if you can prove you did not intentionally defraud the government, you still will have to return the benefits you received for which you were not qualified. That can be quite costly, so don't wait to report the problem It looks far better for you to come clean than to wait until they discover this for themselves. And they will.

If you fraudulently took public assistance, you will be forced to pay it back, fined and could be jailed depending upon the amount.

It would be impossible for one to receive "other" benefits and not know it. You'll have to come up with a better excuse than that...

How can you not know what benfits you are receiving? Cause when you go ask for benfits I am sure they ASK....are you receiving any other types of public assistance? they even do that when you file income taxes.... You could be charged with fraud and have to pay back or jail time.. Because YOU have to know what you are getting... they will see it as you lied about your benfits...

Nice try,but no one receives other benefits and not know.You are busted,accept the responsibility of lying and get a job.
