In a nut shell I have an ex-employee who ran a TV spot for mortagage leads and he wont pay and now the company is trying to sue my corporation.He signed for it and we were never asked by anyone if we would be responsble nor contacted by anyone to see if he could sign for just himself or the company.It was his bill not ours. I know I need to talk to an Attorney but its the weekend and I just got the order to appear.

If the employee, rightly or wrongly, thinks he is acting on behalf of the employer, the employer can be held liable. If you are sued, name the employee as an individual defendant. If you loose, you can then try to collect from the employee.
