I saw an ad that were selling whirlpool cabrios washer 4.5 cu ft capacity model wtw6600sw and dryer model wgd6400sw.My husband called and told them that we were interested in the washer and dryer that they had on the ad. We were told they had a set in white and off white. When we got there I told the gentlemen that we wanted to buy the waher/dryer from the ad. He said they had just sold the dryer but they still had the washer. The washer was brand new w/o the box but they still had the tape on the sides and the styrofoam in the tub. I didn't bother taking off the styrofoam until we got home that is when we realized that they were not the same models advertized. They sold us the washer with 3.8 cu ft capacity. The paper we signed said if an item is returned due to customer error they would charge 25% of the total. Is it our fault for not checking or theirs for selling us a model that we did not ask for? What can I do to get a full refund?

Inform the manager that unless he will not over-ride the 25% rule and make your situation right . . . then you will start with the Better Business Bureau to lodge a complaint.
Then you will contact the news media to relate how the company is being shoddy and using the bait and switch sales thing.
Then you will contact the manufacturer and relate to them how a dealer is giving their product a bad rap.
Then you will seek legal recourse in the Small Claims Court.
Then you will write to the local newspaper Letters to the Editor or something similar where people vent and report shoddy practices.
Then you will begin a boycott of the dealership.
The manager should get the message by this time. Cheers and remember have fun with it because if you allow yourself to become angry -- HE WINS!

Gather all of the written material including a copy of the ad and the box the washer came in. Also make sure you have a copy of any kind of invoice that the seller gave you. Pay him a visit and plead your case. If he refused, you have the option of sueing him in small claims court. Filing fees are usually in the neighborhood of $30.00 and small claims judges hear these kinds of cases everyday. As long as you can support your case with written evidence, you have a good chance of winning your case.
