Check your state statutes. But generally it is legal to record a conversation if one of the parties to that conversation gives permission.

Some states may have differing laws on this. This is the federal law. States may further restrict the law to require both parties' agreement.

Without their knowledge it is. Generally there is an audible beep every second or so. Or, there could be an announcement during the call that annouces that the conversation could be recorded. Then it is up to you what you say and to whom you say it. You can always just make an appointment to meet someone in person and explain that the matter is personal, not something appropriate for discussion on the telephone.

I don't know if it's illegal in Illinois, but where I live, it's permissible to record a conversation if the person being recorded is apprised of that fact, or if he or she gives permission. I think it is more a question of ethics rather than law. I believe it is permissible without prior knowledge or permission in the event of criminal investigations.

Depends on state law, and you'll have to check with the state police. In some states it is completely illegal to do so, even if you are one of the parties being taped. In other states it is legal if only one party knows. But, I believe it is illegal in almost all states if neither party know about it. But even there, there may be an exception if there is no use made of the recording.

To record phone conversation is against the law. Look inside your Yellow Pages and you will see the law.

Yes, without their knowledge. The law is known as "The Lanham Act". It was originally devised to prevent law authorities from invading the privacy of individuals without a warrant.

If you announce to the person whose conversation that you are taping that you are recording it, then that is permissable. It is a matter of consent.

Not when the country has been a target of terrorists. Making it illegal is what the terrorists want. A better question is who's going to stop them?
