i am married for 10 years and we have 7 yr old son. we got seperated last year and i had to move to another state. now my wife doesnt let me talk to my son on the phone nor does she responds to my calls or mails. how can i get visitation or talking rights for me with regard to my son. any advice would be appreciated. thanks

your gonna have to get an attorney for this. If you are paying child support you should get to see or talk to the child. If you are only seperated and not divorced you still need an attorney to make it a legal seperation. Good luck because all that court stuff can take forever, I know I have been through it all.

Well Dave, you've made two mistakes already. First not knowing what separation entails. It's not the next step toward divorce! It's a time to reflect on the mistakes made that are sending you spiraling toward divorce. Second is leaving the state before getting all this new baggage taken care of. Man, your lawyer sucked! He should have discussed all the options before you even left the house! By leaving you've now become an immature abandon-er. You've abandoned your son! Let that sink in! You've abandoned your son! O.K. lets start from here. It's not going to be easy from this point, you've really screwed up! I would immediately get your butt back to your family. Not in the same house but to an apartment close by. Start making support payments now! Try and reconcile with your wife. It won't be easy she probably thinks you're a bonehead for your actions of late. However, this is probably your only chance at a financially possible future. I didn't ask if you wanted to stay married! That's no longer an option to think of, you've messed up to the point your going to be hit with alimony and child support so hard you will never recover. Once you are back in the family, try to act mature, I know this will be near impossible but hey, we all have to grow up sometime. After a year or so then try again for a more intellectual separation! This time don't be an idiot!

Get an attorney and file for parental rights. This will result in support and any back support you owe but she can't legally keep you from your son. It's child alienation. Good Luck

You have to go to court and file for visitation rights. Are you paying child support? the courts will look into that. make sure the environment you are in is safe. Its easy. go for it.
