My ex is threatening to take away my son. But i really dont want my son to go with him because he's violent, had history of being sexually abused (and they still let that guy over at their house), doesnt help support the baby and all this other stuff. My mom and i raised my son alone and couldnt afford to live in cali cuz my mom and dad recenlty separated. So we decided to move to mexico cuz my mom has a house here. I talked all this over with my ex and he seemed to have understood the situation and even gave me a written permission signed by him. Now he's accusing me of running away with my son and wants to take him away.

I want what's best for my son and yes i'd like him to have a father figure but I KNOW he will NOT be a good example or a good guardian to my son. So wat do i do to be able to keep my son?? I know i have to get a job to show i can take care of my baby im working on that now (im 18). i would really appreciate your help please!!

oh and i forgot to mention i'll be moving to Arizona when i have enough money. mexico sucks lol

You need serious information about your rights right now, before you move.

It is not clear whether your "ex" is an ex-husband or not. Since you are only 18, I doubt you were married. However, if an ex-husband your starting point is the divorce decree and what it says about custody and visitation.

The only place that you can get accurate and helpful information is from an attorney who practices family law and has some knowledge of interstate custody issues.

If there was a divorce decree or a paternity decree or even a child support action, hire an attorney there.

If there is no decree, hire an attorney in the state where your ex lives or in the state you and your child lived before moving to Mexico.

Moving from a place where you have the other parent's permission to be to a place where you don't have such permission can be tricky, and could potentially have you charged with parental abduction, which is both a state and a federal felony. So, before you move talk with an attorney.

If you are really searching for answers to your question, you need to speak with an attorney regarding custody issues. You have many issues to resolve such as the fact that you moved to another country leaving the father in the United States where he could get an Order requiring you to return the child to him in the United States. You are planning on returning to the United States and living in Arizona which creates additional concerns for which state would have jurisdiction over the child (ever heard of Anna Nicole Smith and custody of her baby) See a lawyer yesterday. OK..It is VERY hard for a father to take custody from a mother. He'll basically have to prove shes a crack-head streetwalker. My husband wanted to get custody of his kids but our lawyer told us that unless we had some hard evidence that she was abusive or on drugs...we were wasting our time. I'm not sure how to apply for child-support in Mexico, though. Good luck!!

Keep the written permission you have from your ex. Show that to the court, as well as any evidence you have of your ex being violent and non-payment of support.
