You might get the same flesh by cloning but you will never get the same person, so there would be no point to it.
It would be impossible for the clone to have exactly the same experiences and make exactly the same choices as the dead person, therefore cannot develop the same personality or judgement. A cloned person would be a different person.
Identical twins know this.

they wouldnt be able to clone the person once they're dead...
they need living cells and DNA to successfully clone that person..
besides, if they did successfully clone that person, the clone wouldnt be the same age as the person. Its hard to explain, but to get identical twins (where one is a clone), you must clone that person at birth. Clones also have a shorter life span.
in theory, i supose, if that person is found guilty when inocent, and is killed...a clone shouild be allowed...but at this point it time, it would be too late.

Good question, if cloning also brings back all past memories and experiences also, it would be just and proper.
If cloning is not a viable option the condemned person would legally be entitled to restitution.
