I saw an auction on Ebay the other day that appeared to be for a new 60 gig Playstation 3. The dirty snake in the grass part was at the very bottom of the listing it said that it is only for the empty Playstation 3 box, but it was in small print. Tha auction ended at over $600.00. If you fought that would Ebay make you pay still?

jorge n,

yes, ebay DOES consider this fraudulent in most cases.

i might be able to help you with this.

could you email me the item #?

also, how did you pay? did you pay through PAYPAL? did you fund it with a CREDIT CARD?

please send me the details.

also, if you need more help with this, please go here:

http://forums.ebay.com/db2/forum.jspa?forumID=107

that is the link to ebays Trust and Safety Board.

post your problem and see what the wise peeps have to say about this.

you are allowed to post the item # there, but not the sellers ID.

They probably won't make you pay if you report it to them (or honestly, just don't pay, and get a negative feedback if nothing else) but let this be a learning experience for you.

NEVER buy anything on eBay without fully reading and understanding the description. This sort of thing is all too common on eBay!

oh absolutely!

Ebay will go after the guy. If you paid by Paypal, CALL THEM....don't EMAIL...CALL! They'll hold the funds if they haven't been withdrawn...and go after the guy.

Of course, you can do a bit of other calling. If you know the city, call the cops for fraud, call the mayor's office, call ANY high office in that state....I'd even call the state. Call the news in that area....they'll make him popular too.

Small print or not. If the writing is big enough to see, it stated rght in the auction that it was for the box only. No fraud.

the listing stated "it is only for the EMPTY PlayStation Box"....that would not constitute fraud. It was part of the listing.

Probably not. They're pretty good about items that are purposly misleading.

I think they will. Talk to EBaby about it, maybe they won't make you.
