There was a report on the news about this the other day, If the check is fraudulent and you knew it before depositing the check, yes. At the very least you will be held liable for any money you spent. Any time you receive an unexpected or questionable check always let the bank check it out before depositing it and let it sit a week or two before spending it. there are some very good scam checks out there, even some bankers are fooled at first.

You will not go to jail as long as the issuer said that YOU have won it. However, if this is a scam where a marketer has ent you a check to use provided you meet certain conditions, then you have agreed to succumb to those conditions and must follow through. If you do not, it will be viewed the same way as a contract.
Depending on the amount of money involved and your ability to pay it back should you be in default of some kind of condition or presented yourself fraudulently, will determine whether you receive jail time or not.

I don't think so. If you've done nothing illegal to defraud anyone, it would be considered a gift. Especially through the mail if it was unsolicited. Now I would be concerned if you didn't read all the fine print which may require you to repay the funds under certain conditions. In any case, if it was addressed to you and was somehow in error then this is a civil case not a criminal one. Good luck.

I think you need to tell us more for us to give a more educated response. If you got a fake check in the mail and somehow manged to cash it and spend the money, yes! Because it becomes fraud.
