It has become acceptable to say that the North won the American War of the 1860s. However, it would be more correct to say that the federal government created by the Constitution of United States won the war by using the resources of the remaining member States of the Union as well as exceeding its delegated powers.
It is more significant to ask, who lost that war. The answer to that is that all of the States and all of the people lost. The States came together in 1787 and created the federal government by ratifying the Constitution of the United States. That created federal government was to exist entirely within the powers delegated to define it within the Constitution. The war of the 1860s provided the opportunity for the federal government to exceed its delegated powers and change its relationship to the States and to the people. At the end of the war this came to fruition through the 14th Amendment which allowed the federal government to apply the Bill of Rights to the States when the Founders meant the Bill of Rights to be only applied to the federal government.

The north officially won BUT during "reconstruction" union soldiers were sent to the south to protect African- Americans as they voted. As groups like the Knights of the Ku Klux Clan formed it was more and more evident that former slaves were not going to get representation without a fight and they quiet did a tip toed withdrawal. Basically the Americans were not willing to keep troops occupying the south in the mist of terrorist organizations to protect the rights of it's own citizens from others.
