So a friend and I were joking around, and he came up with a "Top 10 reasons to date a gamer" list and wants to make it into a t-shirt.

In one of those reasons, he uses the phrase "Catch them all", and the way it is used is almost a pun(i think) on the popular Pokemon phrase "Gotta catch'em all!".

Now I said "isn't that trademark infridgement?" So I go on to www.uspto.gov to see if the phrase is indeed trademarked.

http://tess2.uspto.gov/bin/showfield?f=doc&state=rn21pj.3.1

The status says it's dead, but I'm not willing to bet on it's safe to use it. I'm sure if he used the word "Pokemon" he could get in trouble though.

My friend is only making the shirt for himself and someone else (not making profit), so he says he is fine. I tell him to wait and let's get some answers first.

So is this a (potential) case of trademark infringement?

No! It is not trademark infringement. The sayings are not the same. And you are not using any unique words (such as "Pokemon").

If it were a printed saying with a readily identifiable type style created and trademarked just for that saying, and you duplicated that type style, you might have a problem.

For example, if I opened a restaurant and called it Moose Burgers and I had a yellow arch style of "M" on my building, I would probably have some problems with McDonalds.

<>First off, "Catch them all" is not the same as "Gotta catch'em all!," so there is no problem there. Second, I'm fairly certain the company is not going to pursue copyright infringement litigation for 2 T-shirts. So, don't sweat it (oops, I think that's been copyrighted!) and have a nice day! (i KNOW that one is! :)
