12month rent, lease still has 4mo left, 2 roomates, 300$ each. Roomate moved out 5mo ago, landlord tried to find him and couldnt. Now he wants to charge me 500$ the price for one person living in the apt.. Can he do that?

What does your lease say? At my last apartment, my roommate and I signed a lease that said that we were joint and severally liable for the rent, meaning that if one of us left, the other had to cover the full $1100/month until the lease ended. What your landlord is doing doesn't sound illegal to me, unless you and your roommate signed separate leases for your "shares" of the apartment or something. If I were you, I'd read through the lease, then look into getting a subletter to offset the extra expense.

You and your roomate signed a lease saying you would pay a total of 600.00 a month. That is what is due the landlord. If your roomie has taken it on the lam then you alone must fulfill the terms of the lease.

Of course, you can always file in small claims court against the idiot roomie to try and recoup the money you will pay but your landlord gets his in any case.

Legally, you are responsible for the rent, but so is your roommate. As much as I know, if you cant pay the rent after a certain period of time, your landlord can change the locks and claim your belongings as his own.

But I would check your local laws and speak to a lawyer, you may get some relief because you and your roomate are both legally responsible for the rent.

If you all singned the lease, then you are responsible if you are the only person left.

did you sign a contract that says this. no he is wrong on this . he cant come after you for the money but he can look for the other renter good luck
