Someone is using my identity. They are taking money out of my account. How can I prove it?

Police. And bank. Call the police and then call your bank.

Worry about proving it when the police are talking to whoever's taking money out of your account. They have ways of figuring out the truth. Really, they do. You won't have to prove a thing.

Transactions have a paper trail and ATMs have cameras.

Well, I only have experience with Chase bank, but I know that their policy gives you only 24 hours to report fraudulent use of your card and get the money back. It is possible that you could sit down with a bank manager and explain the situation, and they might credit your account for a portion of your losses outside of that time frame. You'd have to look into that. But, honestly, if you know that someone is using your card, I don't understand why you have kept the account open. My suggestion is to call the bank's 1-800 number immediately to cancel the card and report the fraudulent use. Ask them what kind of proof they might need from the police as far as a police report or something to file the fraud claim with them. Then, call the police and file the complaint. They may or may not be of much help, but at least the person using your card will not be able to get any more money from it.

First call your Bank and have them freeze your account. Do not cancel account because the police may want to track the activity that is going on with your account. Right after you hang up from bank call your local police station. Do not waste any time, identity theft is hard to recover from.

Call both your bank and the police and let them know. Hopefully, the bank will reinburse you, but the sooner you let them know the better and they can freeze your account and hopefully look for the next transaction trying to be made, and inform the police.

Police first - immediately.
Bank immediately after to freeze your account.
Then check all your credit card accounts for unusual activity.
Lastly check your credit online and look for accounts you have not personally opened or you do not recognize.
