Ok, I had no interest in this woman's life until recent bizarre events.

My question is, how could an appellate judge have legally ruled in her favor when Marshall's will did not include her? The man must have known her greedy intentions but knew he had little time left, so he would have amended his will if he wanted to include her, right? She probably had a trust fund anyway that would have taken care of her for the rest of her life.

Also, how would Dannielynn have a stake in his money when her mother is dead? Wouldn't the lawsuit end at her death since she never had a child by Marshall? I know she's represented by an "estate" but come on!

Instead of changing his will, he set up a trust for her. A court found that Marshall's son forged and destroyed documents so that Anna could not get the money.

Now that she is dead, her estate can fight for the money. Anna's baby does not have a stake in Marshall's money. She has a stake in Anna's money, the money in the original trust that Anna and at least one court have said legally belonged to her at Marshall's death. Even though the Marshalls still have the money, if a court rules that it has legally belonged to Anna this whole time, then her heirs will inherit it.

It is important that estates exist. What if someone hit you with their car and you were badly hurt? If you sued them and they died during the lawsuit, you would still want to continue the suit so you could receive the money that you may be awarded by a court.

That's how the law of succession works i'm afraid!!!

If anna nicole died intestate (without a will) all her estate goes to her next of kin, which would obviously include her daughter.

Her estate needs to be provided for. The reason she has a stake in this money is because the money is part of the estate of anna nicole, which is passed on to her next of kin.

It's just the law sweetheart!

About Dannielynn's stake: She is her mother's sole surviving heir and stands to inherit the sum total of her mother's state.

Since Anna Nicole had a claim on her husband's estate, that claim passes to her estate.

That's not "come on," that's well-settled estate law.

Well, there's a lot more to it than that. HER intentions do NOT matter to the judge at all. All that matters are the decedent's intentions. The judge believed he intended to leave money to her. As for how Dannielynn has a stake, well that's pretty simple, it's a matter of Intestate Succession, and there is a definitive hierarchy for that.
