My fiance and I were broadsided as we were turning left on a yellow light. The man that hit us was traveling at approx. 70-80 mph. I noticed him at about 5-6 car lengths back and he covered the space in about 1-2 seconds.
To make things even more difficult, we have been struggling financially, and had let our insurance lapse. There are many more details to explain it much better.
We need to get an attorney very badly!! We have tried calling several , but no one wants to take the case.
PLEASE HELP!!!!

attornies wont take the case unless they can make some money out of it. a lot of states now, including california, have statutes where if you did not have insurance at the time you were hit, your claim in court is limited to the damages to your vehicle and your medical expenses.

in these states there is no compensation for uninsured drives for pain and suffering---which is where the huge settlements come from and where the attorney makes his money. in addition, the fact that he was speeding was not the "proximate cause of your injuries" -- which is necessary for there to be liability on his part. the fact that he was going 70-80 doesnt really matter when he technically had the right of way on a yellow and you were supposed to look out for it by yielding before you turn.

sorry to tell you, but no attorney would ever take this case, unless you found a friend to do it for free, but expect to pay court costs, and possibly be liable for attorney's fees for the other side if you lose.

You need to be able to pay a retainer and show that you can pay any ensuing bills. The reason no one wants to take it is because there is no insurance and no money on the radar screen. Especially if the other person was uninsured. Do you have that person's info? The prep and investigation for the court date is going to be many billable hours. No "ambulance chaser" in your area advertises that they take cases "on the come"? Good luck to you.

If you didn't have insurance at the time I doubt lawyers will be lining up to assist you in this case. Insurance settlements = lawyer payoff.

If you have a law school in your area, call to see if they have any clinics in which law students (under supervision of licensed attorneys) can represent you. Their payoff is experience.

They won't take the case because it's a LOSER. The only possibility is that they will lessen your damages, and you are a financial risk. You aren't able to even pay for their services. I suggest you call your local Civil Aid service and ask them for help.
