I still have to go through another surgery. And i have a screw in my elbow.

Workers' compensation insurance will cover the medical costs and pay you for the time lost from work (I think they pay you 80% of your wages). If you can't go back to working in your same job/field, the insurance company willl either pay to have you retrained (vocational rehabilitation) or give you a lump sum payment where you waive your rights to further medical treatment of this particular issue. But no, you are not entitled to get paid because surgery caused a scar. That just goes with the territory. Now if your face was disfigured it would be a different story I think. The insurance is there to cover workers who are injured on the job, I don't believe the system is set up to pay you for a scar that you got as a RESULT of them paying for your medical costs. If you think the procedure was goofed and you shouldn't have a scar, it is the doctor or hospital you should be looking at to sue or get money.

If you were injured on the job, then workers comp has to foot the bill for the med expenses (as long as you have not signed for a payoff, that is). As for the scar, it's not like workers comp will pay for something like that. You will have to sue your employer if you really feel that you should be compensated for the scar (you should loose, of course).

Maybe worker's comp, but, I don't think you're going to be receiving any other type of compensation for a scar.

im not sure but i think the only thing you can receive is worker's compensation....also it depends on how large the scar is...if ur not sure you can always talk to a lawyer...good luck!

Since it was an injury on the job, you should qualify for Workman's Compensation.

If you mean damages from a scar, that you are disfigured now, i would bet not.
